Terms of Service

Last updated 2026-10-24

1. About these Terms

1.1 These Terms of Service ("Terms") are an agreement between you and Ben Rogers (ABN 85 543 459 204), trading as Vitrion ("Vitrion", "we", "us", "our"). They govern your access to and use of the Vitrion software, website and related services (the "Service").

1.2 By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which forms part of them. If you do not agree, do not use the Service.

1.3 In these Terms: "Household" means the people, finances and goals you record in the Service; "Position" means the information you enter about your Household, together with the results the Service produces from it and their history; "Subscription" means paid access to the Service, monthly or annual (the two subscription options); and "Subscription Period" means each month of a monthly Subscription or each twelve-month period of an annual Subscription.

2. Eligibility and accounts

2.1 You must be at least 18 years old and able to enter into a binding contract.

2.2 You must provide accurate information when you create an account, keep your sign-in details secure, and tell us promptly if you believe your account has been accessed without your authority. You are responsible for activity under your account.

2.3 You may record information about other people in your Household only where you are entitled to do so. Health information about a person is recorded only once consent is given for that person in the Service. Any account holder of the Household may give that consent, and by giving it confirms that they are entitled to give it for that person.

2.4 More than one person may hold access to a Household, each with their own account. The account that creates a Household is its owner. An owner may invite another person by creating an invitation link in the Service and sending it to that person themselves; we do not send it. The link can be used once, only by an account signed in with the email address it was made for, and expires 7 days after it is created. An owner may withdraw an invitation before it is accepted.

2.5 Every account holder of a Household can see and change all of the information in it, including health information for which consent has been given, and can delete the Household for every account holder. Invite only a person you are content to have that access.

2.6 An account holder may leave a Household at any time, and an owner may remove another account holder, who is told the next time they sign in. The last owner of a Household cannot leave it. If you had your own Household before you accepted an invitation, it is kept, and you return to it when you leave or are removed.

3. The Service

3.1 Vitrion is a model of your finances and a record. It uses the information you provide about your Household to report the range of outcomes your position could take, how likely it is to meet the goals you set, and how each of your decisions moves both, under stated assumptions.

3.2 Each result is kept with the assumptions and the economic and legislative scenario under which it was produced, so that results can be compared over time.

3.3 Your Position reflects what was recorded about your Household on a given date. It is not a statement of account. The institutions that hold your money keep the authoritative record of your balances, and you should not rely on the Service as a statement of your holdings.

4. General information only

4.1 The Service provides general information only. It is not financial product advice, and it does not take into account your objectives, financial situation or needs in recommending any course of action.

4.2 The Service compares scenarios and reports their modelled outcomes, including where an outcome is highest or lowest across a range you choose. That is analysis of your Position, not a recommendation: the Service does not recommend or endorse any option, financial product, strategy or provider, and the choice is always yours.

4.3 Vitrion does not hold an Australian Financial Services Licence and is not your financial adviser. Before making a financial decision, you may wish to obtain advice from an appropriately licensed adviser.

4.4 This clause applies to everything the Service produces, including results and commentary, and to information about Vitrion and its features.

5. The AI assistant

5.1 The Service includes an AI assistant ("Agent") with two modes. In Ask, you lead: Agent helps you examine your Position and run comparisons on it, and changes your Position when you ask it to. In Interview, Agent leads: it asks you about what your Position does not yet contain, each question in the form its answer takes (a choice, a date, an amount and its period, or yes or no), and records your answers in it.

5.2 Agent will not answer a question that asks it to choose for you, such as which investment, product or tax position to adopt. Where it declines, it explains why and offers the comparison or figure from your Position that addresses what it can.

5.3 Agent uses a large language model provided by Anthropic. Its responses are checked automatically before they are shown to you, to withhold statements that recommend a course of action or that state a figure not drawn from your Position. Automated checks may not detect every error. Agent's responses are generated automatically, are not reviewed by a person, and may be inaccurate. Check any figure against your Position before relying on it.

5.4 A Subscription includes 1,000 questions to Agent each month.

5.5 Each section of your Position and Decisions can hold notes in your own words. You can write a note, and Agent may add one from your conversation with it, marked as coming from that conversation. You can edit or remove any note. Your notes are read by Agent, and so are sent to Anthropic as clause 4 of the Privacy Policy describes; the engine that produces your results never reads them.

5.6 Where the Service suggests questions you might ask, it ranks them from modelled households in a situation like the one you describe, not from your Position, and the description you give for this stays in your browser unless you choose to send your questions to us. A suggested question is general information, not a recommendation to ask it or to act on its answer.

6. Without and with a subscription

6.1 Without a Subscription, the Service includes one Household, the chance of meeting your goals with its margin, the assumptions register, unlimited simulation runs and ten questions to Agent each month. It does not include scenario comparison or export.

6.2 Your Position is kept in full with or without a Subscription. A Subscription adds features that operate over your Position; it does not unlock information withheld from it. If your Subscription ends, those features stop and your Position remains.

7. Price, billing and renewal

7.1 A Subscription is sold monthly or annually, in advance, at the prices shown on our pricing page when you subscribe. At the date of these Terms, those prices are AUD $3,047 per year, or, for a monthly Subscription, AUD $1,447 for the first month and AUD $147 for each month after that. Monthly payments count toward the annual price: in each twelve months counted from the day a monthly Subscription began, you never pay more than the annual price, and once your payments reach it, the rest of those twelve months is included at no charge.

7.2 We are not registered for GST, and no GST is charged. If we become registered, prices will include GST.

7.3 Payment is taken within the Service. The price includes AI usage under clause 8, and there are no usage or overage charges.

7.4 Your Subscription renews automatically at the end of each Subscription Period unless you cancel it. For an annual Subscription, we will remind you at least 30 days before each renewal, with the renewal price and how to cancel.

7.5 Our prices are set by our own pricing model and may change when that model is revised. If we change the price, the new price applies from your next Subscription Period, and we will notify you at least 30 days before it takes effect.

7.6 You may move between the two subscription options, monthly and annual. The change takes effect at the end of your current Subscription Period. If you move from monthly to annual, what you have paid in the current twelve months counts toward your first annual payment.

7.7 A Subscription can be bought only with a billing address in Australia.

8. AI usage

8.1 Each Subscription includes an allowance of AI usage. When an allowance is used, the relevant feature is unavailable until the allowance resets at the start of the next period. Unused allowance does not carry over.

8.2 To provide Agent, the information needed to answer your request, including figures from your Position, is sent to Anthropic, which processes it outside Australia. The Privacy Policy describes what is sent.

9. Cancellation

9.1 You may cancel your Subscription at any time from within the Service. Cancelling takes no more steps than subscribing.

9.2 Cancellation takes effect at the end of the current Subscription Period. Your Household then continues without a Subscription: your Position is retained and remains accessible, and features included only in the Subscription stop.

10. Refunds

10.1 If you request a refund within 30 days after your first Subscription begins, we will refund what you paid for its first Subscription Period in full. You do not need to give a reason.

10.2 For an annual Subscription, in any other case, if you request a refund during a Subscription Period, we will refund the price of that Subscription Period in proportion to the whole months remaining in it.

10.3 A monthly Subscription is not refunded for part of a month, except under clause 10.1 or where required by law.

10.4 When a refund is given, the Subscription ends and your Household continues without one, as described in clause 9.2.

10.5 Nothing in this clause limits your rights under clause 11.

11. Australian Consumer Law

11.1 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded, restricted or modified.

12. Your information and our intellectual property

12.1 You own the information you enter about your Household, including your description of your goals and the notes you write, whether entered in a form or changed in place in your Position's narrative. You grant us a non-exclusive licence to store, process and use it only to provide the Service to you and as described in the Privacy Policy.

12.2 The results the Service produces about your Household, and the notes Agent adds to it from your conversation with it, form part of your Position and are yours to use for your own purposes.

12.3 We own the Service, including its software, models, methodology, assumptions, scenarios and design. Nothing in these Terms transfers any of them to you.

12.4 We will never sell your information or use it for advertising.

13. Exporting your Record

13.1 Export of your Position is available on paid Subscriptions.

13.2 This does not limit any right you have under the Privacy Act 1988 (Cth) to request access to your personal information. We handle those requests as set out in the Privacy Policy.

14. Retention and deletion

14.1 You may delete individual items, or your entire Household record, at any time from within the Service.

14.2 Where more than one account holder has access to a Household, any of them may delete it, and deleting it deletes it for every account holder. Each other account holder is told that the Household was deleted the next time they sign in, and that notice is kept until they dismiss it. An account holder who wishes only to stop sharing may leave the Household instead, unless they are its last owner.

14.3 Deleted information is removed from the live Service immediately, and from backups within the backup cycle described in the Privacy Policy.

14.4 A record of who has held access to a Household and when, and of the invitations made to it, including each invited email address, is kept while the Household exists and is deleted with it.

14.5 If your Subscription ends, your Position is still kept until you delete it, subject to our obligations under the Privacy Act 1988 (Cth).

15. Confidentiality of your Household

15.1 We will never publish your Household's information or results in any form, including in de-identified form. Any worked example we publish uses a fictional household.

15.2 We may publish information about the Service's own methods and limitations, including what it cannot model, but never information about any real household.

16. Assumptions and limitations

16.1 Every result is the output of a model run against stated assumptions. The assumptions are shown with the result and in the assumptions register, which is available with or without a Subscription.

16.2 A chance is not a forecast, and a range is not a guarantee. Results depend on the scenario they state, and actual events may differ. We do not warrant that any result will prove correct.

16.3 The Service is designed so that the same information, assumptions and version of the model produce the same result.

17. Errors and corrections

17.1 If we identify an error in the Service, we correct it without deleting the earlier result. The original result and the correction are both kept in your Position, with a description of what changed.

17.2 A later calculation that changes your result does not erase the earlier one.

18. Availability and changes to the Service

18.1 We aim to keep the Service available, but we do not guarantee that it will be uninterrupted or error-free. Market data may be delayed or unavailable.

18.2 We may change or withdraw features. If a change materially reduces what your Subscription provides, we will tell you in advance and, on request, refund the unused part of your Subscription Period.

19. Limitation of liability

19.1 You are responsible for your own financial decisions. The Service reports modelled outcomes; it does not make decisions for you.

19.2 Subject to clause 11, and to the extent permitted by law: (a) we are not liable for any indirect or consequential loss, or for any loss of profit, opportunity or investment return, arising from your use of the Service or your reliance on any result; and (b) our total liability to you in connection with the Service is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

19.3 Where our liability for failing to comply with a consumer guarantee can lawfully be limited, it is limited to supplying the services again or paying the cost of having them supplied again.

20. Suspension and termination

20.1 We may suspend or close your account if you use the Service unlawfully or in a way that interferes with the Service or its other users. Unless it is urgent or unlawful to do so, we will tell you why and give you notice first.

20.2 If we close your account, we will keep your Position for the period stated in our notice before deleting it, so that you can access, export (where your Subscription includes it) or delete it.

20.3 Your Position is deleted immediately only at your request.

21. Changes to these Terms

21.1 We may update these Terms. We will notify you at least 30 days before any change that adversely affects your rights, your price or what the Service provides takes effect.

21.2 If you do not accept a change, you may cancel your Subscription before it takes effect and receive a refund of the unused part of your Subscription Period.

21.3 Each version of these Terms is dated, and previous versions are available on request.

22. Contact and notices

22.1 You can contact us at contact@vitrion.com.au. We may send notices to the email address associated with your account.

23. Governing law

23.1 These Terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts able to hear appeals from them.

24. General

24.1 If any part of these Terms is invalid or unenforceable, it is severed, and the rest of these Terms continues in effect.

24.2 A failure or delay in exercising a right is not a waiver of it.

24.3 We may transfer our rights and obligations under these Terms to a company we control, including on incorporation, by notifying you. The transfer does not reduce your rights under these Terms.

24.4 These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
